Ergea UK and Ireland Limited “Ergea” Terms and Conditions for Access to the Ergea Portal
1. Acceptance of Terms
By accessing and using the Ergea Portal ("the Portal"), you ("User") agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you must not use the Portal.
2. User Obligations
You agree to provide accurate and complete information when registering for an account and updating your profile.
You agree to keep your username and password confidential and not to share them with others.
You agree to use the Portal solely for the purposes for which it is intended and in accordance with these Terms and Conditions.
You agree to comply with all applicable laws and regulations in connection with your use of the Portal.
You agree not to infringe upon any third-party rights, including intellectual property rights, when using the Portal.
You agree not to interfere with or disrupt the operation of the Portal or any other User's use of the Portal.
3. Access and Use Restrictions
You agree not to access or attempt to access any part of the Portal that you are not authorized to use.
You agree not to engage in any activity that could be harmful to the Portal, its users, or its reputation, including but not limited to:
Spamming or sending unsolicited messages.
Hacking or attempting to hack the Portal.
Creating fake accounts.
Using the Portal for illegal purposes.
You agree not to bypass or circumvent any security measures implemented on the Portal.
4. Limitations of Liability
The Portal is provided "as is" and "as available," without any warranties of any kind, express or implied. Accordingly we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with your use of the Portal, including but not limited to damages for loss of profits, data, or other intangible losses.
We are not responsible for the accuracy, reliability, or legality of any content provided by third parties on the Portal.
We reserve the right to temporarily suspend or discontinue access to the Portal for maintenance or other reasons without prior notice.
5. Intellectual Property
The Portal and its content, including but not limited to text, graphics, images, and software, are owned by Ergea UK and Ireland Limited and the relevant software providers including Palantir Technologies UK Ltd and are accordingly protected by intellectual property laws in England and Wales, the UK and beyond. All copyright shall remain with the original owners.
These Terms and Conditions do not grant you any ownership rights in the Portal or its content.
You agree not to copy, reproduce, or distribute any copyrighted or trademarked material on the Portal without explicit permission.
6. Termination
We may terminate your account or restrict your access to the Portal if you violate these Terms and Conditions or for any other reason, with or without notice.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
8. Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Ergea with respect to your use of the Portal and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
9. Modifications
We reserve the right to modify these Terms and Conditions at any time by posting the revised terms on the Portal. Your continued use of the Portal after such modifications shall constitute your acceptance of the revised terms.
